Liquipel disclaims all liability for errors, inaccuracies or omissions that, from time to time, may be contained on the Website. Your acknowledgement and agreement to fully and completely abide by the above mentioned disclaimer of warranty is contractually binding to you upon your transfer of currency (cash or credit card) for purchase of the Liquipel service.
Data Loss Liability
You understand and agree that Liquipel shall not be liable for any loss, damage, corruption, or alteration of any files, folders, data, programs or any of your confidential, proprietary, business, and/or personal information or removable media (“Data”). You are responsible for backing up any files, folders, data, programs, contacts, and media prior to sending your device to Liquipel for treatment.
Limitation of Liability
To the full extent permitted by applicable law, Liquipel, its affiliates and employees will not be liable for any loss or damage of any kind arising from or related, directly or indirectly, to the use of, or inability to use, either the Website or any information, content or other materials contained therein, including, but not limited to, general, indirect, special, incidental, consequential, exemplary or punitive damages, even if Liquipel had been advised of, knew or should have known of the possibility of such damages. If any part of this limitation of liability is found to be invalid or unenforceable for any reason, then the aggregate liability of Liquipel, its affiliates and employees shall be limited to the amount paid by you to Liquipel, if any, for accessing the Website. At no time and in no event shall Liquipel or its employees’ total liability to you for all damages in any one or more causes of action, whether in contract, tort (including, but not limited to, negligence) or otherwise, exceed the amount paid by you to Liquipel, if any, for accessing the Website.
Except as otherwise specifically provided herein, we make no representations or warranties, express or implied, including to the extent permitted by applicable law, any implied warranty of merchantability or fitness for a particular purpose, about our coating material or application process or about your device.
Liquipel is a unique coating that is meant to protect your electronic device from damage resulting from accidental and incidental exposure to liquid. WE NEVER SUGGEST OR RECOMMEND THAT YOUR DEVICE EVER COME IN CONTACT WITH WATER OR ANY OTHER TYPE OF LIQUID. We do not warrant that the coating of your device will work perfectly or that it will work under all conditions.
We warrant that the coating will be applied to your device in accordance with our design specifications and that neither the coating material nor the application process will damage your device. We are not responsible for any damage which may occur to your device, including, but not by way of limitation, through your use or misuse of your device or during shipping to or from our coating facility.
Unless otherwise noted, the Website and all materials contained on the Website including product names, details, descriptions, photographs and illustrations (the “Contents”) are the sole property of Liquipel and/or its licensors. The Contents are protected from unauthorized copying and dissemination by copyright law, trademark law, international conventions and other intellectual property laws and may not be reproduced, republished, transmitted, distributed or used on any other website without Liquipel’s prior written consent.
No Illegal or Improper Use of Website
You may not use the Website or any Contents for any illegal or improper purpose. You agree to indemnify and hold harmless Liquipel, its affiliates and employees for any investigation, defense, settlement or legal proceeding arising out of or relating to your illegal or improper use of the Website and/or the Contents.
All customers will purchase return shipping when completing their order through the Liquipel™ website. The customer is then responsible for covering the cost of shipping their device to Liquipel™ headquarters at 2911 Tech Center Drive Santa Ana, CA 92705. Liquipel™ recommends that customers insure their devices when shipping them to us for treatment. Liquipel™ will not be held liable for any damage the device may have incurred during the shipping process; however, if we receive a device that we believe has been damaged during shipment we will contact the customer prior to the treatment process.
All customer devices will require a signature for return delivery as Liquipel™ insures all devices during return shipment. If an individual will not be available to sign for the device upon delivery they may contact FedEx directly for other available options or to have the device held at the nearest FedEx location to the delivery address. In the event that a device is not delivered to a customer after several delivery attempts by FedEx, the device will be returned to Liquipel™ headquarters. The customer will then be responsible to cover the cost of shipping the device for a second time and we will honor the original shipping option unless otherwise requested by the customer.
We ship to the 48 continental United States, Alaska, Hawaii, and Puerto Rico.
We apologize for the inconvenience, but we are unable to ship to all APO, FPO, and DPO addresses via FedEx. If a customer wishes to have their device shipped back to an APO, FPO, or DPO address they must purchase shipping during the checkout process, but then include a pre-paid shipping label for USPS for the return shipment. Once we have received the device and have verified that a pre-paid shipping label is included we will refund the customer for the cost of shipping they paid when completing their online order.
We are unable to ship via FedEx to PO Box addresses (domestic or international). If a customer includes a PO Box for their return shipping address we reserve the right to hold the device until we have confirmed a physical address from the customer. We also reserve the right to hold the device longer than the turnaround time (Standard or Priority) that the customer chose when ordering if necessary.
FedEx Ground/Home Delivery: Delivery within 1 to 5 business days based on the distance to the destination (delivery to Alaska and Hawaii in 3 to 7 business days).
FedEx 2Day: Delivery by 4:30 p.m. in 2 business days to most areas, by 7 p.m. to residences. Available throughout all 50 states.
FedEx Priority Overnight: Delivery by 10:30 a.m. the next business day to most areas; by noon, 4:30 p.m. or 5 p.m. to remote areas. Available throughout all 50 states. Saturday pickup and delivery available in many areas for an additional charge.
Due to the nature of our business we are unable to offer refunds for most orders in which the Liquipel™ coating has already been applied to the customer’s device. If a customer wishes to cancel an order before shipping the device they may receive a full refund including the cost of return shipping. In order to receive a full refund, customers must forward the confirmation email they received after completing their order to firstname.lastname@example.org and request to cancel the order.
In the event that a device which is coated with Liquipel experiences a manufacturer’s defect, the customer may send us the replacement device and we will apply the Liquipel coating free of charge for up to 30 days after acquiring the replacement device. The customer will be required to provide us with proper documentation which states that the original device was replaced due to a manufacturer defect. The customer must provide us the requested documentation either via email or by including a hard copy with the device upon shipment. The customer is responsible for the cost of shipping the replacement device to us and must include a pre-paid shipping label for return shipping of the device.
Liquipel Gift Card Cardholder Agreement
These terms and conditions govern your use of the Liquipel Gift Card (“Terms and Conditions”). By purchasing or using the Liquipel Gift Card (“Card”), you are agreeing to these Terms and Conditions. The terms “you” and “your” refer to the person who purchased the Card and/or the person who is using the Card. The terms “we” “our” and “us” refer to Liquipel, LLC and its subsidiaries and licensees that issue pre-paid cards.
Where can the card be used?
Redeem the Card for payment by entering the Card number as a discount code on our website (www.liquipel.com/shop). You may also redeem the Card for a Drop-Off service at our corporate retail location in Santa Ana, CA. We recommend that you retain your receipt for treatment as a record of the purchase.
Are there any fees for the use of the Card after purchase?
This card has no fees after purchase; however, online customers may be required to cover the cost of shipping when completing the check-out process.
Do the funds on the Card expire?
Card expiration laws will vary by State. Please review your State’s Gift Card provisions and recent legislation by visiting the website of the National Conference of State Legislatures.
Should the receipt from the purchase of the Card be kept?
We strongly recommend that you keep the receipt from the purchase of the Card, as we may require it for a refund, exchange or replacement in accordance with our Return/Refund Policy.
What if the Card is lost or stolen?
If the Card or Card number is stolen, contact us immediately at 1.855.478.4735. You must provide your name, Card number and other details for identification purposes. You agree to give us all reasonable information to help make a complete investigation of the lost or theft of the Card. If the Card or Card number is reported by you as lost or stolen, we will issue you a replacement Card with a value equal to the Value or Available Balance on the Card at the time you notified us of the loss or theft. NO REFUNDS WILL BE PROVIDED FOR AMOUNTS DEDUCTED FROM YOUR LOST OR STOLEN CARD BEFORE YOU NOTIFY US.
Can the services purchased with the Card be returned?
Due to the nature of our business we cannot accept returns for the Liquipel service. However, in the event that your coated device is replaced due to a manufacturer’s defect we will treat the replacement device at no cost to you. We will require the proper documentation from the manufacturer stating that the device was replaced. You will be responsible for covering the cost of shipping the replacement device to and from our facility.
Third Party Content
The Website may contain links to third-party websites that are not owned or controlled by Liquipel. Liquipel has no control over, and assumes no responsibility for, the content, privacy policies or practices of any third-party websites. By using the Website, you expressly release Liquipel from any and all liability arising from your use of any third-party website.
In addition, the Website may contain third-party material, including, but not limited to, product reviews and customer comments. Each third party is solely responsible for the material that they post on the Website. When reviewing third-party material included on the Website, please be aware that such material is solely the opinion of the third party and that the third party may or may not be an independent, unbiased individual qualified to provide such material. Liquipel takes no responsibility, and assumes no liability, for any third-party material posted on the Website.
We have made every effort to display the colors of our products as accurately as possible on this Website. However, we cannot guarantee that your computer monitor’s display of any color will be accurate.
Liquipel reserves the right to cancel or refuse to fulfill any order at any time. If we cancel or refuse to fulfill an order, we will issue you a refund and attempt to contact you at the contact information provided to Liquipel at the time the order was placed.
Choice of Law/Venue
This Agreement shall be construed in accordance with the laws of the State of California, without regard to any conflict of law provisions. Any dispute arising under this Agreement shall be resolved exclusively by the state and federal courts located within the County of Orange, State of California.
Severability of Provisions
If any provision of these Terms shall be deemed invalid, void or unenforceable for any reason, then that provision shall be deemed severable from the remaining provisions and shall not affect the validity and enforceability of the remaining provisions.
Liquipel reserves the right to modify the Website or these Terms at any time without notice. Any such changes will be effective immediately. It is your responsibility to regularly review these Terms to inform yourself of any changes. Your continued use of the Website after any changes to these Terms constitutes your consent to the changes.
